SUBJECT	:	ETA 9016 Report Revised

1. Purpose. To transmit a revised version of the ETA-9016, Alien Claims Activity Report.
   
   
2. Background. States are required to verify the legal status of all aliens applying for unemployment insurance benefits, using the INS' Systematic Alien Verification for Entitlement (SAVE) system. The Department of Labor must gather information from state agencies concerning alien claimant activities, and the ETA-9016 is the vehicle for collecting this information.
   
   

   Recent analyses of the ETA-9016 identified a lack of consistency in the interpretation of the reporting instructions among state agencies, each of which must apply the instructions to claimstaking procedures that vary significantly. In order to encourage more consistency in reporting, several data items have been consolidated.
   
   

3. Report Changes. With this revision, the two items reporting nonmonetary determinations and the two items reporting denials have been consolidated into one item each as follows:
   
   
   • Nonmonetary determinations on the alien issue.
     
     
   • Denials resulting from the nonmonetary determinations on the alien issue.
     
     
   Consolidation of the reporting items on nonmonetary determinations will eliminate the distinction between issues detected through the SAVE process and issues detected through other means, as will consolidation of the reporting items on denials. This will simplify the reporting process with no corresponding loss of the Department of Labor's ability to evaluate the effectiveness and cost efficiency of the SAVE process in the individual state agencies.
   
   
4. Office of Management and Budget (OMB) Approval. These reporting requirements have been approved by the OMB under the Paperwork Reduction Act of 1995, OMB Approval No. 1205-0268, expiring 02/28/2005. Persons are not required to respond to this collection of information unless it displays an OMB approval number. Respondents= obligation to reply to this reporting requirement is mandatory under the Social Security Act, Section 302(a). Public reporting burden for this collection of information is estimated to average one hour per response, including gathering and maintaining the data needed, and completing and reviewing the collection of information. 5. Effective Date. The revised reporting instructions will be effective beginning with the third quarter of calendar year 2002; the report is due in the National Office by October 25, 2002. States are responsible for ensuring that all necessary reprogramming is completed.
